Troy Notary & Signing Services welcomes you to troynotary.com (“Site”). Throughout the Site, the terms “we”, “us” and “our” refer to Troy Notary & Signing Services. The troynotary.com website is comprised of various web pages operated by Troy Notary & Signing Services.

This Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (“Terms”).

Client Content (“Content”) refers to anything transferred to Troy Notary & Signing Services for the client’s website creation and/or modification, including all documentation, images, and photos whether it be hard copy or in electronic format provided by the client or purchased on behalf of the client.

This  Site may contain links to other independent websites (“Third-Party”).

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

This Site is governed by our Terms and Conditions and our Privacy Policy. By using this Site, you agree to these Terms and Conditions and our Privacy Policy, collectively, the (“Agreement”).

Troy Notary & Signing Services offers Notarial and Administrative Services

Troy Notary & Signing Services and troynotary.com offers general notarial services, mortgage loan notarial services, apostille services, permit processing services and basic web design services. We can also assist clients with administrative and courier services. Fees for specific services may change without notice. Common fees will be posted on troynotary.com.

TroyNotary.com is an Notarial and E-commerce Site

TroyNotary.com helps other notaries and small businesses to create modern websites. We also provide an à la carte of our services. We offer WordPress Template design, web hosting, domain purchase, and website maintenance.

Your Agreement

Your use of troynotary.com constitutes your agreement to all such Terms. Please read these Terms and Conditions carefully before accessing or using our website. The Terms and Conditions may be amended, from time to time, without prior notice and at our sole discretion. Unless otherwise indicated, amendments will become effective immediately. Please review these Terms and Conditions periodically as it is your responsibility to check for changes. Your continued use of the Site following the posting of changes and/or modifications will constitute your acceptance of the revised Terms and Conditions.

By accessing, viewing, or using any part of this Site for information or purchases, you acknowledge that you have read, understand, and agree to be bound by, and to comply with, these Terms and Conditions, including those additional Terms and Conditions and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the Site, including without limitation users who are browsers, clients, vendors, merchants, and/or contributors of content. Troy Notary & Signing Services reserves the right to refuse service to anyone or any company for any reason at any time.

Use of Services

This Site is for browsers, clients, future clients, vendors, merchants, and contributors only for the intended purpose. Any other use of this Site is prohibited.

TroyNotary.com does not knowingly collect, either online or offline, personal information from children under the age of thirteen. If you are under 18, please do not use troynotary.com for any purpose. This Site is not intended for children.

The following types of content and behaviors are prohibited from being provided to Troy Notary & Signing Services nor to be communicated or performed on your website(s) hosted or designed by us. If we find that a client is communicating any of the following list or anything not mentioned in the following list, that we deem to be harmful or offensive, we will shut down the site  permanently or suspend the site until the offense(s) have been corrected.

  • Any Content or materials that is not trademarked, copyrighted, or licensed by you. Only use this content if you have permission to do so. It is your sole responsibility to be liable for removing all illegal content and paying all damages incurred.
  • Any content you are not authorized to use.
  • Any content or disclosure of other people’s private and personally identifiable information.

Without limiting our other remedies, we may restrict, suspend, or terminate your and any user’s access to this website and related services at any time, at our sole discretion and without any prior notice, including the termination of services that are already under way.

Troy Notary & Signing Services does not grant you any licenses, express or implied, to the intellectual property of Troy Notary & Signing Services or our licensors except as expressly authorized by these Terms.

Your use of the Site does not entitle you to make any unauthorized use of any protected content. You will use protected content solely for your personal use and will make no other use of the content without the express written permission of Troy Notary Signing Services and the copyright owner.

Third-Party Access

If we provide you with Third-Party access, you understand we do not monitor, endorse, nor control Third-Party websites, they’re available for your convenience, and you use them at your own risk. You agree that these Third-Party websites, apps, plugins, or software are “as is” and “as available” without any warranties, or conditions of any kind.

We shall have no liability from any harm or damage relating to your purchase or use of goods, services, resources, content, or any other transactions made in connection with any Third-Party website. You are responsible to be familiar with and approving the terms and conditions of the Third-Party providers before making a purchase.

Third-Party links on this site may direct you to Third-Party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any Third-Party materials or websites, or for any other materials, products, or services of Third-Party websites.

Certain services made available via Troy Notary & Signing Services are delivered by Third-Party websites and vendors. By using any product, service or functionality originating from the troynotary.com domain, you hereby acknowledge and consent that Troy Notary & Signing Services may share such information and data with any Third-Party with whom Troy Notary & Signing Services has a contractual relationship to provide the requested product, service, or functionality on behalf of troynotary.com users and clients.

Complaints, claims, concerns, or questions regarding Third-Party products should be directed to the Third-Party website.

Electronic Communications

Visiting or sending emails to troynotary.com constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically, via email, text, and on the Site, satisfy any legal requirement that such communications be in writing.

You understand that your Content (not including credit card information), may be transferred unencrypted and involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

Cancellation/Refund

Troy Notary & Signing Services does not refund travel fees, mortgage loan service fees, courier fees, or administrative fees.

Notarial act fees are not refundable unless there was an error made by the notary on the certificate. If the error made by the notary is made during the transaction, the notary can perform a new notarial act to replace the error at no additional charge.

Notary errors discovered after the transaction has been completed and the parties have separated need to be corrected by the notary as soon as possible, within 7 days of the original notarial act, if possible. There will be no notarial act fee charged for corrections, but there may be a travel fee.

Appointments for correction should be made no later than 7 days after the original notarial act. All errored certificates must be voided and/or destroyed by the notary.

Pre-paid payments and subscription fees for web design, web hosting and website maintenance can be prorated and refunded if you decide to end business dealings with Troy Notary & Signing Services. Long projects can be split into smaller checkpoints. All work completed up to and at checkpoints must be paid for in full. Refunds will be handled on a case-by-case basis and may constitute a partial refund.

Disclaimer of Warranties and Limitation of Liability

You understand that if the information we provide on this Site is not current, complete, accurate or contains typos, we do not warrant the completeness or accuracy of the materials of this Site. You understand that Troy Notary & Signing Services does not warrant the reliability of any advice, opinion, statement, or other information displayed or distributed through this Site. You agree that if you rely on any information on this Site to make your decisions without consulting a more current, complete, and accurate source of information, you do so at your own risk. This Site is provided on an “as is” and “as available” basis.

You understand and agree that under no circumstances, including, but not limited to, negligence, shall Troy Notary & Signing Services be liable for any direct, indirect, incidental, special, punitive, or consequential damages that result from the use of, or the inability to use, any Troy Notary & Signing Services Site or materials or functions on any such Site, even if we have been advised of the possibility of such damages. Our total liability to you for any damages (regardless of the foundation for the action) shall not exceed in the aggregate the amount of fees actually paid by you to us during the month immediately preceding the act allegedly giving rise to our liability.

You understand that if you download or obtain any material from this Site, you do so at your own risk, and/or your computer is damaged, including, but not limited to, viruses, spyware, software, or hardware damage, or any of your data is lost from the download of such material, you are solely responsible.

Troy Notary & Signing Services makes no warranty with respect to the results that may result from the use of this Site, user enjoyment, Site downtime, the products or services advertised are fit for a specific purpose, or merchants involved.

We reserve the right to halt, cancel, or discontinue service during a service appointment without providing a refund if we suspect any fraudulent or unsafe activity. If fraudulent activity occurs during one of our service transactions and we are unaware of the fraud committed and we followed the proper identity proofing process, we will not be held responsible or liable for any and all damages incurred to anyone due to the fraud.

Without limiting our other remedies, we reserve the right at any time to change, suspend, or discontinue any of our services without notice. We shall not be liable to you or any others for any changes, suspension, or discontinuance of any of our services. Any new services or features added to Troy Notary & Signing Services and the current Site will be subject to the Terms and Conditions.

Troy Notary & Signing Services is not responsible for the accuracy, completeness, quality, or timeliness of information, images, photos, or any other Content provided by the client. You are solely responsible for all your Content and maintaining backups of your Content and websites.

We do not maintain usernames or passwords beyond the creation, setup, and deployment of your website. We would need written permission and login credentials by you for any future or initial access to your site. It is the client’s responsibility to change their login credentials once Troy Notary & Signing Services has deployed, completed services, and/or transferred the website to the client.

Troy Notary & Signing Services is responsible for client Content received in proper and usable form/format. We are not responsible for unencrypting any content or corrupted content.

Information or links provided on this Site are for general information only. We have no obligation to update any information on our site, even if it is not current.

Force Majeure

Troy Notary & Signing Services shall not be liable to you for any failure to perform any obligation under these Terms  and Conditions or otherwise, due to an event beyond our control, including but not limited to any act of nature, terrorism, war, political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood, or any other natural or manmade eventuality outside of our control.

Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to any conflict of law provisions. The waiver of any provision of these Terms shall not be considered a waiver of any other provision or of our right to require strict observance of each of the terms herein. If any provision of these Terms is found to be unenforceable or invalid for any reason, that provision shall be severable, and all other provisions shall remain in full force and effect.
