The meaning of these common terms in notarial wording

Affiant – The signer of an affidavit. An affidavit is a statement made under oath or affirmation.

Attest – When you sign the document for notarization, your confirming, with your signature that the document is authentic or true.

Deponent – The signer of a deposition. A deposition is a signed transcript of the signer’s oral statements taken for judicial proceedings. Notaries administer oaths for signers’ of depositions.

Depose – Is the act of questioning someone under oath.

Duly sworn – A person put under oath by an officer authorized to administer oaths in accordance with the law.

Execute – When a signer completes all the formalities of a notarial act to make it effective.

Foregoing instrument – The instrument, the document of interest for the notarization.

Instrument – The document(s) requiring notarization.

Subscribe – When a signer consents or gives approval by signing their name as a participant or creator of a document.
