The difference between an Oath and an Affirmation

Oaths administered during a notarial act are formal and serious promises spoken to a Supreme Being. The person making the oath is pledging that they are being honest and telling the truth. Oaths are usually conducted with a sense of formality and ceremony. The Notary and signer can raise their right hands. The signer can be asked to repeat an oath after the Notary, or if asked an oath in question format, the signer MUST answer out loud, “I do” or with similar words. Oaths are legally binding.

Affirmations administered during a notarial act are formal and serious promises spoken on one’s own personal honor, without any mention to a Supreme Being. The person making the affirmation is pledging, on their own personal honor, that they are being honest and telling the truth. Affirmations may also be conducted with a sense of formality and ceremony, in the same way as an oath. Affirmations are also legally binding.

Sometimes a notarial certificate may be titled as a jurat. A jurat is very similar to an acknowledgment, click here for a more detailed explanation between an acknowledgment and jurat. The only differences is that a jurat MUST be signed and dated in the presence of the Notary and an oath MUST be administered by the Notary.
